Armed vs Unarmed Security Guard: The California Legal Reality

Private security in California operates under Business and Professions Code Chapter 11.5 (BPC 7580 et seq.), enforced by the Bureau of Security and Investigative Services (BSIS). The framework is layered: a company holds a Private Patrol Operator (PPO) license; an individual holds a guard card (Security Guard Registration); and to carry a firearm on duty, that individual must additionally hold an exposed firearm permit issued after passing a 14-hour firearm training course and range qualification. Penal Code section 25850 (formerly 12031) prohibits loaded firearms in public — the BSIS firearm permit is one of the enumerated exemptions that allow an on-duty licensed guard to carry a loaded sidearm openly.

Legally, very little. Both armed and unarmed licensed guards operate under identical use-of-force authority under Penal Code section 835a (reasonable force to effect arrest) and section 692 (self-defense and defense of others). The presence of a firearm does not expand arrest authority — a private security officer, armed or not, has the same authority as any private person under Penal Code 837 (citizen's arrest for a felony committed in their presence, or misdemeanor if a breach of peace). What the firearm does is provide the officer a proportional response option in a lethal-force encounter, and enable an armed escort to comply with cash-in-transit insurance requirements.

In 20+ years of Sacramento security operations across the ownership group, four categories consistently justify armed service on a risk-adjusted basis: (1) cash handling above a policy threshold — bank branches, cannabis dispensaries, jewelry, cash-heavy retail, ATM servicing; (2) documented threat with named subject — an active restraining order, terminated employee with credible threat, high-profile family with credible risk; (3) events with alcohol, cash, and >500 attendees where the crowd-control math points to armed on the perimeter; (4) high-value cargo or storage — pharma, precious metals, firearms retailers. Outside those four, unarmed patrol handles the operational need.

Standard apartment patrol, HOA patrol, construction night watch, vacant-building patrol, standard retail, standard office — armed is almost never the right answer. The presence of a firearm changes the officer's use-of-force calculus, raises the liability exposure of every encounter, and drives insurance premiums up 40–70%. The deterrence delta between marked armed patrol and marked unarmed patrol on standard property crime is small; the deterrence delta between any marked patrol and no patrol is huge. Buy the patrol, not the firearm.

Commercial property carriers in California underwrite the security profile of the site as a factor in premium. The presence of armed security on a residential property (apartments, HOAs) triggers a re-rate at renewal that typically runs 40–70% higher on the general liability portion of the policy. The reasoning is straightforward — an armed encounter has more severe outcomes on average than an unarmed one, and the property owner is a named defendant in the resulting suit under theories of negligent hiring and premises liability. Get a quote from your broker before you sign an armed contract; the security bill is only the visible part of the cost.

BSIS-mandated training for guard card issuance is 40 hours over 6 months (8 hours pre-work, 32 within 6 months). For the exposed firearm permit, an additional 14 hours of classroom plus live-fire qualification at 21 rounds minimum. Annual re-qualification is required to maintain the firearm permit. Legitimate PPOs also run internal use-of-force training on their armed personnel every 6 months at minimum — this is where the operational safety actually comes from, not the BSIS floor. When you evaluate an armed vendor, ask for the internal training curriculum in writing.

Loaded firearms in public are prohibited under Penal Code 25850. The statute enumerates categories of persons exempt from that prohibition: peace officers, certain retired peace officers, licensed hunters in season, and — item (c)(6) — persons possessing a valid California BSIS firearm permit while on duty. The exemption is site-specific and time-specific. An armed guard on their scheduled shift, in uniform, carrying the permitted sidearm at the caliber on the permit, at the location assigned by their PPO, is lawfully carrying. The same person off-duty, out of uniform, or with a different sidearm is not covered by that exemption and must rely on their own concealed carry (CCW) permit if they hold one.

Under Penal Code 837, any private person (including a security guard, armed or unarmed) may arrest another for a public offense committed in their presence, or for a felony they have reasonable cause to believe was committed. The arrest must be immediately turned over to a peace officer. The security guard has no expanded authority beyond this. Where armed guards get into legal trouble is asserting authority they do not have — 'freeze,' 'get on the ground,' 'you're under arrest' commands work only within the actual scope of PC 837 and can otherwise be false imprisonment.

For property crimes short of felony, the tool that gives your officer real authority is Penal Code 602 combined with a written trespass authorization letter from the property owner and posted 602-compliant signage at every entry. With those in place, an unarmed officer can lawfully order a trespasser to leave, effect an arrest for refusal, and hold for peace officer transport — no firearm required. Most residential and commercial patrol authority derives from this framework, not from being armed.

Question one — is there cash on site above $10,000 outside a compliant safe? If yes, armed. Question two — is there a named specific threat backed by police report or restraining order? If yes, armed. Question three — does your insurance broker recommend armed for the site profile? If yes, armed. If none of the three is yes, unarmed patrol with proper cadence, GPS-verified tours, and 602 authority delivers the deterrent effect at one-third the cost.

For accounts on the margin, a hybrid model works well: unarmed patrol as the standing coverage, with an on-call armed response tier for specific escalations (alarm activation with confirmed intrusion, tenant conflict escalation, credible threat event).
